Tender success depends on numerous factors beyond our analysis including proposal quality, pricing, competitor responses, evaluation criteria, and procurement decisions entirely outside our control.

1.3 Data Storage and Retention
Document Storage:
Uploaded tender documents are stored on Australian Cloudflare R2 servers for exactly 24 hours, then permanently and automatically deleted. This ensures we can process your analysis while minimizing data retention risks.
Email Addresses:
- Stored securely on Australian servers for service delivery
- Retained until you request deletion or unsubscribe from all communications
- Used only for report delivery and optional newsletter (with consent)
1.4 Data Security
- All data processed and stored on Australian servers
- Industry-standard encryption for data in transit and at rest
- No international data transfers outside Australia
- Regular security assessments and updates
- All uploaded documents are automatically deleted after 24 hours

Under the Privacy Act 1988, you have the right to:

2.1 Service Description
AUO provides AI-powered analysis comparing tender documents against response documents to identify potential compliance gaps. Our service is for informational and analytical purposes only.
2.2 No Success Guarantees
IMPORTANT: We make no guarantee, representation, or warranty that use of our service will result in winning tenders, securing contracts, or any specific business outcomes.
Factors affecting tender success include but are not limited to:
- Proposal quality, pricing, and competitiveness
- Competitor submissions and market conditions
- Evaluation criteria and procurement decisions
- Government policy and budget considerations
- Compliance requirements beyond our analysis scope
2.3 Limitation of Liability
To the maximum extent permitted by law:
- AUO's total liability for any claim is limited to the amount paid for the specific analysis service
- We exclude liability for indirect, consequential, or special damages
- We exclude liability for business losses, lost profits, or lost opportunities
- We exclude liability for decisions made based on our analysis
Australian Consumer Law Compliance:
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any consumer rights that cannot be excluded, restricted or modified under Australian law.
2.4 User Responsibilities
You agree to:
- Provide accurate information and documents
- Use the service lawfully and ethically
- Not upload confidential information beyond what's necessary for analysis
- Make your own independent decisions regarding tender submissions
- Comply with all applicable laws and regulations
2.5 Intellectual Property
- AUO retains all rights to our analysis technology and methodology
- You retain ownership of your uploaded documents
- Analysis reports are provided for your internal use only
- You may not reverse engineer or copy our service
2.6 Service Availability
- We aim for high service availability but make no uptime guarantees
- We reserve the right to suspend service for maintenance or technical issues
- We may modify or discontinue features with reasonable notice
2.7 Termination
- You may stop using our service at any time
- We may suspend or terminate access for breach of these terms
- Upon termination, uploaded documents are deleted within 24 hours as per our retention policy
2.8 Governing Law
These terms are governed by Australian law. Any disputes will be resolved in the courts of Queensland, Australia.
3. Refund Policy
Money-Back Guarantee for Monthly Subscriptions
Monthly Subscriptions ($347/month): 7-day money-back guarantee applies to monthly subscription plans only.
3.1 Refund Eligibility
- One-time Analyses ($47): No refunds. These are final purchases for immediate analysis services.
- Monthly Subscriptions ($347): Full refund available if requested within 7 days of the initial subscription payment.
3.2 Refund Process
To request a refund for eligible monthly subscriptions:
- Contact our support team at support@auo.com.au within 7 days of your initial payment
- Include your subscription details and reason for the refund request
- Our team will verify eligibility and process the refund within 5-7 business days
- Refunds will be credited to your original payment method via Stripe
3.3 Refund Conditions
- Refunds are only available for the initial subscription payment, not renewal charges
- Subscription access will be revoked immediately upon refund processing
- Refund requests must be made within 7 calendar days of the subscription start date
- We reserve the right to refuse refunds for suspected fraudulent activity or abuse
- Refunds are processed through Stripe and subject to their processing times
Note: Cancelling your subscription stops future charges but does not automatically trigger a refund. You must explicitly request a refund within the 7-day window to be eligible.
